Horrific brutality is being done by the Obama Administration’s U.S. Bankruptcy Court to a cancer ridden, helpless 89 year old World War II veteran who received two bronze stars involving the incredible rescue of 2,000 U.S. Prisoners of War from vicious Japanese guards at the Los Banos Internment Camp in Luzon, Philippines in 1945. Montana’s Warren C. Bodeker is being tossed out of his Plains, MT home by Christy Brandon, a Montana Federal Bankruptcy Trustee, practicing in Bigfork, Mt. She refused to continue a capacity hearing even as he was suffering in a Helena VA Hospital from advanced stage prostate cancer spreading throughout his body. The bulletin CIR received contained the following update: “But despite the well established fact that Mr. Bodeker was in the hospital, the trustee, Christy Brandon, opposed the motion to continue the hearing. U.S. Bankruptcy Judge Honorable Ralph B. Kirscher denied (this) motion; Brandon then Emailed Mr. Bodeker (whose own lawyer quit) to tell him she would be at his home on 11 Freedom Lane, Plains, MT, with a sheriff’s deputy to kick him out of his home and have the locks changed” on June 18, 2012.
Now what’s even worse, the sick and dying veteran who belonged to the Co. B, 511th Parachute Infantry Regiment, 11th Airborne Division must at his own cost have the remains of his dead wife Lorna dug up and moved from the home where they planned to be buried next to one another. Her five year long battle with cancer left him with so many medical and credit card bills he had to file for bankruptcy. And that’s when his real nightmare began. Because the couple had some gold and silver coins he failed to disclose, he was pressured into signing some sort of stipulation agreement which he did not understand, thereby forcing him to lose his bankruptcy and homestead exemption protections. Christy Brandon–according to the internet Email by Liberty.com—is serving as the trustee for the estate, the lawyer for the estate, and as the attorney for herself as trustee, all in one! According to witnesses, the poor old guy was led to believe he was going to lose everything, no matter what he did or didn’t do. The Email says despite the well established fact that Mr. Bodeker was in the hospital, trustee Brandon opposed the motion to continue the hearing. Even though he was set to undergo a competency examination which could show he lacked the capacity to enter into the stipulation, the judge denied the old man’s motion, acting pro se, to continue the hearing and the judge then granted the order for the World War II hero to vacate his property!
You can view his pitiful video at (2). The Los Banos Raid is considered to be the textbook example of the perfect rescue operation in military history. Paratroopers, including Private Bodeker, tumbled out at day break behind enemy lines, to free our POWs before brutal Imperial Japanese guards could carry out their planned slaughter of our men. Not one POW was killed. And this is the thanks the old veteran gets when he is too old to fight his own battles!
No words can express the lack of compassion, the bald brutality, the crass cruelty of a U.S. judicial system so devoid of any sense of patriotism to someone who put his life on the enemy line to save his fellow Americans. Commenters are over the top in their criticism of what one called “Another National Disgrace on the New America.” Another said, “This is crazy.” Finally, this comment says it all: “This is an outrage! This makes me so mad. Treating our veterans like crap. This is just sick.” Montana’s two U.S. Senators, both Democrats, are Jon Tester and Max Baucus, who can be called toll free at 1-877-762-8762.

As much as I dislike Obama for going all out to destroy America, I can't make the connection between Obama and this Vet. From the logic I use, and perhaps it is flawed, regarding this story, there is no connection beyond there being a Federal Judge and a Federal Bankruptcy Trustee and Obama being President and his involvement . It appears to me, that the heartlessness of the persons actually involved in relieving this Vet of his property rests upon the Judge and the Trustee. Are we talking about Laws in forces that were carried out? It seems that we dislike Obama so much that we are trying to do everything we can to place blame on him for whatever happens on the Federal level This is basically what Obama is doing…"placing all blame on someone else." He blames Bush for everything he does wrong. I think that such is the case here. This is a very emotional argument and hardship case being made for a hero of WWII and the basis of the argument seems to rest upon that for support. It simply appears to be a law that was carried out without heart and compassion. Sometimes, people and life simply suck!

I agree. To blame Obama directly and personally for the actions of the individual officials in Montana seems akin to the Left saying "Its Bush's fault" when anything happens. We Conservatives are better than that, I hope. I am also confused about how he is to be kicked out of his house while he is at he same time said to be dying in the hospital. Needs some clarification

This is an example of an arrogant PUBLIC SERVANT who either doesn't give a hoot about the people she serves, or is too stupid to take circumstances into consideration. This veteran has done more for this Country than this miserable example of a (so-called) judge.
For the past decade or more, thanks to legislation created by Miss Bawnie Frank and Criss Dodd, illegals and unemployed blacks have been given money by banks intimidated into making loans they had no chance of collecting on. It was these two DC criminals who are directly responsible for the "housing bubble" and resulting crisis.
So as homes have been literally given to people with neither the means nor the desire to pay for them, this American hero is being thrown out of his!
The question isn't whether Obama is responsible for this particular incident, but rather how many MORE are taking place right now of which we are unaware!
We were taught in my 50s journalism classes at the University of Illinois that the tone is set from the top down/ our professors taught us what to look for in reporting on actions of institutions and that the tone (attitude or method of operating) comes from the top of the totem pole/ also,as I rec'd the information, Mr. Bodeker was evicted this past Monday even as he was flown to the VA Hospital in Helena, MT, for what he thought was a bad case of kidney stones/ this terrible pain turned out to be advanced stage prostate cancer/he built that home with design help from his beloved wife Lorna/they planned to be buried side by side/now he must somehow get her body moved to the cemetery in Paradise, MT/the website for sending him financial help somehow disappeared/
Suzanne…despite what you were taught in journalism class, one does NOT plot the graph first and then attempt to back-fill it with very sad facts and some specious conclusions.
While it is okay to set the tone….it is up to the readers to decide what is "tone" and what is an attempt to "tar and feather" by association, however remote.
You know that I detest B.O…..but criticisms must be launched directly to him…not through tenuous and weak association.
The dilemma of Warren Boedeker has been the intransigence and heartlessness of this Christy Brandon person who has gotten herself appointed as judge, jury, and executioner of Mr. Boedeker's civil rights.
She has exhibited only a disdain toward the protection of Mr. Boedeker's rights.
What ought to have occurred was a 'stay' of judgement until the passing of Mr. Boedeker.
Someone needs to deal most harshly with this skeleton-picker. Had I been her supervisor she would be looking for new employment.

Raymond, my comment was directed to the article in which Suzanne assumed and stated that Obama was at fault for Mr. Bodeker's eviction. Of course, Obama is tied to the Fed and the Laws within the Fed. However, for this article, there was no connection made to tie Obama to the Vet's situation or hardship at all. For me, Obama is demon led, a Muslim and an usurper. As bad as he is, no case has been made to substantiate the charge that Obama had anything to do with handling of the Vet's situation. I place the blame entirely upon the Judge and the Trustee. Further, not all 'tones' are set at the top. The only case made here in the article against Obama is based solely upon an emotional support for the Vet and his hardship.

The term "capacity" has a different/specific meaning in bankruptcy law than the legal term "competency," as in "mental competency." Is the reference above to a mental competency hearing or to a bankruptcy capacity hearing?
If it is the latter, it may well have been that the poor guy's presence was not required, and that's why the judge ruled in favor of the govt lawyer's motion.
In addition to all that has been said, the Bankruptcy Laws in the US right now are very punishing and highly mechanical in nature allowing little discretion on the part of magistrates. This was not always the case, but massive changes were made to both Chapter 7 and Chapter 13 actions at the behest of the credit and companies and banks. They pushed these changes through a Republican Congress in the early Bush Administration. As a staunch conservative and lifelong Republican I nevertheless opposed many of these changes as I and others could see who might, as in the case of the Vet here, be badly affected. I sincerely believe the changes made then, while in some ways needed, were in other ways — as this case seems to suggest — harmful.
This is not a case of Obama doing this directly to an honored veteran who happened to stand in defense of everything Obama despises in our society and is attempting to destroy. But, he is complicit in having an already created degeneration of our moral values exacerbated by those he may not be aware of but in all likely hood, whose party had some culpability for placing in this in the hands and under the judgement of a true and heartless curmudgeon. To do this is an utterly immoral position. We give every break we can to illegal aliens. We subsidize those whose first act on our soil is to violate our laws and then be rewarded for it. It is disgusting that we allow THAT, but it is a travesty, that our government will not help a decorated man who served with valor and honor to be buried with his wife. you will have stolen his home.what more can you take from him, YOU PARASITES!

Just read up some more on poor Mr Bodeker's case. Gosh, who would have ever thought that medical bills and credit card debt would lead to bankruptcy in America. Plus the fact that a confused Mr Bodeker thought he didn't have to disclose his gold and silver coins to the bankruptcy court. Sad, sad case.
Keep working on it "grace" you are "nearing" mental competency.
My father's family is from Canlubang, PI. They and neighbors risked their lives throwing food over the fence to prisoners at Los Banos. This bureaucrat cannot hold a candle to the heroism of that generation of Americans and Filipinos and SHE IS AN INSULT TO SOCIETY! How she can sleep at night, I don't know, but in the long run, she will have to answer to our Creator when her day is done.
