Supreme Court to conference on Obama eligibility today

by Suzanne Eovaldi, staff writer

Today, February 15, 2013, Attorney Orly Taitz brings her request to move the Obama eligibility challenge from conference to the oral hearing stage at the US Supreme Court. She is moving forward in spite of the fact that four African-American Supreme Court clerks refused to allow Taitz to see the signature of Justice Anthony Kennedy who denied her petition originally. “But I resubmitted to Justice Roberts, and he sent it to the conference,” Taitz said. (1)

The California attorney is asking “…how do we know that he (Kennedy) ever saw the brief?” In no uncertain terms clerk James Baldin told me that “I (Taitz) [was] not allowed to see the signature.” This denial of her right to see Kennedy’s signature “does not make any sense.” Perhaps her Russian ancestry and background knowledge of the suppression of citizens caused her to note similarities with DC police actions that blocked “more and more streets” during Obama’s … Continue Reading:Supreme Court to conference on Obama eligibility today

Why did the Chief Justice CHEAT to save ObamaCare?

by Doug Book, staff writer

Chief Justice John Roberts rewrote the specific language of congress by claiming in his ObamaCare ruling that the penalty which the lawmakers had clearly attached to the individual mandate was actually a tax. It was the only way in which the Affordable Care Act could be saved, for the Court rejected the Commerce and Necessary and Proper clause defenses as constitutional grounds for the existence of the law.

By “penciling in” the tax language necessary to satisfy his own requirement of constitutionality, Roberts behaved no differently from any liberal, activist judge so often criticized by conservatives for judicial malfeasance; that is, he cheated rather than rule against a personally favored piece of legislation.

The question is WHY? WHY did the Chief Justice defraud the Court and the American public rather than rule ObamaCare unconstitutional?

In the majority opinion, Roberts wrote: “The Federal Government does have the power to impose a … Continue Reading:Why did the Chief Justice CHEAT to save ObamaCare?

Chief Justice Roberts gets tax decision WRONG, provides Congress with unlimited power

by Doug Book, staff writer

John Roberts is said to be quite concerned about the way in which history will view his tour of duty as Chief Justice of the Supreme Court. Well he doesn’t have to worry any longer, for his remarkable decision allowing Congress to impose a tax improperly and in a previously unconstitutional manner will secure his place in Court history for all time.

Very few—including Obama himself—believed the scheme of presenting the individual mandate penalty as a tax would pass constitutional muster. The DOJ included a “the penalty is actually a tax” argument in an ObamaCare brief to the Supreme Court, to be sure. But that was a typical lawyers’ game of “throw everything against the wall and see if it will stick.” It was upon the Commerce Clause powers of congress—and to a lesser extent, the Necessary and Proper clause– that the DOJ and Solicitor General Donald Verrilli depended to … Continue Reading:Chief Justice Roberts gets tax decision WRONG, provides Congress with unlimited power

Senator Leahy attacks Supreme Court, threatens Chief Justice Roberts

by Doug Book, staff writer

Two months ago, Barack Obama decided he could intimidate the United States Supreme Court into finding his namesake healthcare plan Constitutional. Overturning the Affordable Care Act “…would amount to an unprecedented, extraordinary step of judicial activism” said the President at a rare White House news conference, adding “…I’m confident that the Supreme Court will not take what would be an unprecedented extraordinary step of overturning a law that was passed by a strong majority of a democratically elected congress.” (1)

Though someone with the hyper-arrogant mentality of the Manchurian Candidate doesn’t really need a reason to direct this sort of psycho-babble at a presumptive enemy, Obama was probably responding to information provided by far left Justice Elena Kagan that the Court’s closed-door, preliminary vote on ObamaCare had not gone very well. Each Friday the 9 justices gather for an initial vote on the cases heard during the week. And although … Continue Reading:Senator Leahy attacks Supreme Court, threatens Chief Justice Roberts
