Will Gunwalking Violations of the Arms Export Control Act Spell Doom for the Regime?

 Why waste time asking “what did you know and when did you know it” questions reminiscent of the Watergate investigation when Obama Regime targets of the Grassley/Issa congressional committees might already face felony charges?

That’s the question Attorney David Hardy and others are asking those investigating the role of Regime members in the deadly gun walking fiasco,  Fast and Furious.

Since whistle blowers brought this scheme to the attention of Congress early this year,  Senator Charles Grassley and Congressman Darrell Issa have been frustrated by Department of Justice stonewalling,  subterfuge and misrepresentation.

As Grassley wrote to Attorney General Eric Holder in a July 18th correspondence,  “If the attorneys working on the [Justice]  Department’s  response to the Committee spent less time redacting documents and more time producing them,  we would be much closer to understanding the failures in leadership surrounding Operation Fast and Furious.”

But it is Hardy’s contention that the leadership at the Department of Justice,  the ATF and perhaps the FBI and DEA are in violation of the Arms Export Control Act of 1976.

Written to make certain that members of the Executive Branch do not “mistakenly” sell arms to terrorists or tyrants,  the Act clearly states that a President selling “defense articles” to another nation must first receive a permit from the Secretary of State. Nevertheless ,  no permit is necessary if those articles are:

1.) For official use by a department or agency of the United States government;  or

2.) for carrying out any foreign assistance or sales program authorized by law…

As Hardy rightly concludes,  “the firearms involved  [in Fast and Furious]  were not being exported for official use by an agency,  nor as part of foreign aid.” 

And although the people who made the straw purchases or transported the weapons across the border are obviously guilty under the Act,  Administration officials who encouraged or permitted these violations are equally liable,  as “principles.”

“Whoever commits an offense against the United States or aids,  abets,  counsels,  commands,  INDUCES OR PROCURES its commission,  is punishable as a principle.” 

And U.S. gun store owners were certainly “induced” to sell weapons to known straw purchasers by the ATF,  just as the DOJ,  FBI and DEA “commanded”,  “counseled”,  and “procured” the commission of illegal Fast and Furious sales and the transport of those weapons.

How does our government treat private companies or individuals found guilty of violating the AECA? In 2009, John Reece Roth,  a former University of Tennessee professor was sentenced to 48 months in prison for sharing technical data concerning the work he was doing for the Air Force.

In 2007, ITT was fined $100 million dollars for transferring classified information about lasers and countermeasures to Singapore.

And this year, Swiss Technologies Inc,  a New Jersey defense contractor was fined $1.1 million dollars for sending drawings and specifications of gun parts to a Chinese company so that those parts might be produced more cheaply when fulfilling contractual agreements with the US Defense Department.

Will the Regime remain immune to United States law? Or will the Grassley/Issa committees eventually get around to bringing charges which could result in the downfall of Obama and his cronies!

The Gunwalking story is just getting warmed up.

Obama Regime NOT to blame for Gunwalker, decides Democrat Congressman Cummings

 On June 30th, Maryland Democrat Congressman Elijah Cummings assembled gun confiscation advocates and 2nd amendment foes from across the nation to approach the Gunwalker/Fast and Furious debacle by doing what the Left does best…changing the subject.

As it is not in the nature of liberals to allow truth to interfere with agenda, the Congressman decided to ignore the fact that Obama Regime members at the ATF had directed the sale of thousands of weapons to drug cartel straw buyers and assisted in trafficking those guns across the Mexican border.

Instead, Cummings claimed that “no legitimate examination of [drug cartel violence and illegal firearms trafficking] will be complete without analyzing our nation’s gun laws, which allow tens of thousands of assault weapons to flood into Mexico from the United States each year.”

It apparently escaped the Congressman’s notice that it was President Obama’s ATF and DOJ which fractured those gun laws and caused a flood of weapons across the border in the first place!

So with the embarrassing facts of Gunwalker properly shoved under the table, the Cummings Forum offered the following recommendations to halt the flow of arms across the border:

 Increase the Penalties for Illegal Straw Purchases.

 Enact a Dedicated Firearms Trafficking Statute.

 Implement a Multiple Long Gun Sales Reporting Requirement 

Now the unabridged Federal Guide to Gun Laws is 400 pages long. So everything illegal about gun manufacture, import, purchase, use, ownership or sale is already “on the books.”

For example, lying on the federal form required to purchase a weapon carries a penalty of “not more than 5 years” in prison. So a straw purchaser can be sentenced to 5 years for EVERY gun he purchases and then delivers to someone else for their use.

Smuggling or trafficking a weapon into Mexico carries a maximum $250,000 fine and prison term of up to ten years. Again, this is for each charge.

 Therefore, firearm smugglers, traffickers and straw purchasers are already dealt with under federal statute. But rather than hold the Obama Regime responsible for its deadly, criminal scheme to undermine the right of the American people to keep and bear arms, Cummings chose to put the blame for Gunwalker’s illegal sales on a fictitious lack of adequate legislation.

What of the long gun reporting requirement? Mandatory firearms registration has been a dream of the Left for decades. And even though Gunwalker has already been exposed as a scheme to manufacture a necessity for more restrictive gun control legislation, liberals like Cummings continue their march toward the national registration–and eventual confiscation–of all firearms owned by the American people.

 The New York Times placed blame for Gunwalker/Fast and Furious on the passion of American gun owners for their weapons. The Washington Post decided Fast and Furious might not have happened if the ATF “…had other, more effective tools at its disposal.” And the L.A Times lamented the “impossible mission” of the ATF, given the perpetual grievances of the “gun lobby.”

Liberal sycophants like liberal Democrat Elijah Cummings seek to absolve the Obama Administration of blame for the Gunwalker debacle. It looks as though he’ll always have plenty of help from his Leftist cheering squads.
